You may remember the story of the Canadian woman who stopped her car on the left-hand side of the highway to help some ducks.
She was eventually convicted of two counts of criminal negligence for causing the death of a 50 year-old motorcyclist and his 16 year-old daughter. Now, her case has been settled and she got 90 days behind bars.
Her license was also suspended for a period of 10 years and on top of that she has to perform 240 days of community service. She was to originally be convicted of nine months in jail, but her defense argued that since there was no criminal intent on her part that it should be reduced.
Now, the woman has filed an appeal and is hoping to at least do something about the 10-year ban.
The case goes further her way as a local police officer testified that the motorcyclist was actually traveling above the legal limit when he collided with the back of the woman’s car. This sounds like there is a chance for a jury to be more lenient when her appeal comes up, if this information has not already been considered.
